Road Rage in Phoenix — Jekyll and Hyde Behind the Wheel

Car Accidents

There’s something about getting behind the wheel that causes some people to lose all sense of civility. Even mild-mannered people can transform into aggressive, reckless drivers when something triggers them on the road. In a metro area like Phoenix — with wide highways, fast speeds, and heavy traffic — road rage incidents are disturbingly common.

Road Rage vs. Aggressive Driving

Arizona law distinguishes between the two. Aggressive driving under A.R.S. § 28-695 occurs when a driver commits a combination of traffic violations — speeding, tailgating, unsafe lane changes, failure to yield, running red lights — while creating an immediate hazard. It’s a Class 1 misdemeanor.

Road rage goes further. It involves intentional acts — following someone to confront them, brake-checking, forcing another driver off the road, using a vehicle as a weapon, or physically assaulting another driver. Road rage can result in felony charges including assault, endangerment, or even attempted murder.

Why Road Rage Matters for Your Case

If the driver who caused your accident was in a state of road rage, your case may be worth significantly more. Intentional or reckless conduct opens the door to punitive damages — damages designed to punish the wrongdoer beyond just compensating you for your losses. Arizona allows punitive damages when the defendant’s conduct was willful, wanton, or reckless.

What to Do If You’re a Victim of Road Rage

Do not engage. Don’t make eye contact, don’t gesture, don’t escalate. If another driver is following you aggressively, drive to a police station, fire station, or other public place — do not go home. Call 911 while driving (using hands-free). If possible, get the aggressive driver’s plate number and vehicle description.

If a road rage incident leads to an accident, tell the responding officer exactly what happened — the tailgating, the aggressive maneuvers, everything leading up to the crash.

Phoenix’s Aggressive Driving Problem

With our data showing 47,000+ accidents per year in Phoenix and the deadliest window being the 3–6 PM rush hour on Fridays, the conditions for road rage are ripe. Frustration, heat, and congestion are a volatile combination. The Law Badgers take road rage cases seriously — because the victims deserve both compensation and accountability.
