Your Rights as a Passenger in an Uber or Lyft Accident in Arizona

Car Accidents

Rideshare use in Phoenix has exploded — especially around events, nightlife, and spring training. But what happens when you’re a passenger in an Uber or Lyft and the driver causes — or is involved in — an accident?

The Good News: You’re Almost Always Covered

As a passenger, you weren’t driving either vehicle. You have zero fault. Your injury claim is against whichever driver caused the crash — whether that’s your Uber/Lyft driver or the other vehicle.

Insurance Coverage

Uber and Lyft both carry $1 million commercial liability policies that apply when a driver is actively transporting a passenger. This means there’s substantial coverage available — far more than a typical personal auto policy.

However, these policies are managed by insurance companies that aggressively defend claims. Getting the full value of your injuries requires navigating the gap between the rideshare company’s coverage, the driver’s personal policy, and the other vehicle’s insurance.

Who Do You Sue?

Depending on who caused the accident, your claim may be against the rideshare driver (covered by the rideshare company’s policy), the other vehicle’s driver (covered by their personal policy), or both — if both drivers share fault.
