Driving Too Slowly in Arizona — Yes, You Can Get a Ticket

Everyone knows you can get a ticket for speeding. But did you know you can be ticketed in Arizona for driving too slowly?

The Law

A.R.S. § 28-704 states that a person “shall not drive a motor vehicle at such a slow speed as to impede or block the normal and reasonable movement of traffic.” The statute identifies two exceptions: when reduced speed is necessary for safe operation due to conditions, and when the vehicle is on a grade (hill) and the reduced speed is due to the weight of the load.

If you’re going to drive below the normal speed of traffic, you must stay in the right-hand lane or as close to the right edge of the road as practicable — unless you’re preparing to turn left.

Why Slow Driving Is Dangerous

A vehicle traveling significantly below the speed of surrounding traffic creates a hazard. Other drivers must brake suddenly, change lanes, or maneuver around the slow vehicle. This increases the risk of rear-end collisions, sideswipe accidents, and multi-vehicle pileups — especially on highways.

Liability When Slow Driving Causes an Accident

If a driver’s unreasonably slow speed caused or contributed to an accident, they may be found negligent. The violation of A.R.S. § 28-704 establishes negligence per se if the slow driving was the cause of the crash.

That said, Arizona’s comparative fault rules mean the following driver who rear-ends a slow vehicle may also share liability. Each case depends on the specific facts.
