Here’s why — and what actually determines your settlement value.

Why “Average” Is Misleading

An “average” settlement lumps together a $5,000 fender-bender with soft tissue injuries and a $2,000,000 wrongful death case. The resulting “average” tells you nothing about what your specific case is worth.

Online settlement calculators are worthless for the same reason. They exist to collect your contact information, not to value your case.

What Actually Determines Your Settlement

Injury severity and permanence. A herniated disc requiring surgery is worth dramatically more than muscle strain that resolves with physical therapy. Permanent impairment, scarring, and loss of function increase value significantly.

Total medical bills. Past and future medical costs form the foundation of most settlement calculations. This includes ER visits, surgery, physical therapy, chiropractic care, imaging, prescriptions, and any future treatment you’ll need.

Lost wages and earning capacity. Time missed from work, reduced hours, and — for severe injuries — permanently reduced earning capacity.

Pain and suffering. Arizona does not cap non-economic damages. A jury can award whatever it determines is fair for your physical pain, emotional distress, loss of enjoyment of life, and impact on your daily activities and relationships.
