How Much Does a Car Accident Lawyer Cost in Arizona?
If you’ve been in a car accident and you’re worried about the cost of hiring a lawyer, here’s the short answer: you pay nothing unless we win.
That’s not marketing language — it’s how personal injury law works in Arizona. It’s called a contingency fee, and it means the entire financial risk is on the attorney, not on you.
How Contingency Fees Work
When you hire a personal injury attorney on a contingency fee basis, you sign a retainer agreement that specifies the attorney’s fee as a percentage of your recovery. The standard contingency fee in Arizona is 33.3% (one-third) of the settlement or verdict.
Here’s what that looks like in practice: if your case settles for $150,000, your attorney receives $50,000 and you keep $100,000 (minus any case costs and medical liens). If your case settles for $0, your attorney receives $0 and you owe nothing.
You pay zero upfront. No retainer. No hourly fees. No billing surprises. The attorney fronts all case costs — filing fees, medical record requests, expert witnesses, court reporters, everything.
What About Case Costs?
Case costs are separate from the attorney’s fee. These include expenses like obtaining police reports and medical records, expert witness fees, court filing fees, deposition costs, and postage and copying.
These costs are typically advanced by the attorney and deducted from your settlement along with the attorney’s fee. If there’s no recovery, most contingency agreements state that you owe nothing for costs either. Read your retainer agreement carefully to confirm.
Do I Need a Lawyer, or Can I Handle It Myself?
For a minor fender-bender with no injuries, you can probably negotiate directly with the insurance company. But if you have any injuries requiring medical treatment, the math strongly favors hiring an attorney.
Studies consistently show that accident victims represented by attorneys recover significantly more — even after the attorney’s fee — than those who negotiate on their own. Insurance companies know this, which is why they try to settle quickly before you hire a lawyer.
Questions to Ask Before Hiring
Before you sign a retainer, ask the attorney: What is your contingency fee percentage? Does the percentage increase if the case goes to trial? Who pays case costs if we lose? Will a partner or an associate handle my case? How will you communicate with me?
